Terms & Conditions

By accessing or using the services provided by FundExera, you ("User" or "Customer") agree to be bound by these Terms & Conditions ("Terms"). These Terms govern your use of the FundExera mobile application ("App"), website ("Platform"), and related services.

If you do not agree to these Terms, do not click "I Accept" or "I Agree," and refrain from downloading, installing, or using the App or any associated services.

1. Definitions

For the purposes of these Terms:

  • 1.1 "App" or "Application" refers to the mobile application developed by FundExera to offer its loan services to customers.
  • 1.2 "Lender" refers to a bank or Non-Banking Financial Institution (NBFI) with whom FundExera has entered into a loan-sanctioning agreement. The Lender approves, manages, and disburses loans via the Platform.
  • 1.3 "Company," "we," or "us" refers to FundExera, a business duly incorporated under Indian law.
  • 1.4 "Customer," "User," or "You" refers to any individual who accesses, uses, views, or saves the Platform and the Services it provides.
  • 1.5 "Loan" means the financial assistance that Users may request via the Platform, approved and disbursed by the Lender in accordance with the Loan Agreement.
  • 1.6 "Loan Agreement" refers to the written or electronic contract containing all terms and conditions related to the Loan, executed by both the Lender and the Customer.
  • 1.7 "Platform" or "Website" refers to the FundExera website and mobile application that provide Users access to our Services.
  • 1.8 "Third-Party Platforms" refers to websites and social networks not directly under FundExera's control, such as Facebook, LinkedIn, and similar platforms.
  • 1.9 "User Data" refers to all personal and financial information provided by Users to FundExera prior to, during, or after using the Services.

2. Eligibility and User Obligations

2.1 To access and use the Services, you must:

  • Be of legal age and mentally competent to enter into a contractual agreement.
  • Provide accurate, complete, and up-to-date User Data.
  • Comply with all applicable laws, regulations, and guidelines of India.

2.2 By using the Services, you authorize FundExera to:

  • Collect, verify, and maintain your User Data, including financial documents, bank account information, PAN card details, and credit history from relevant sources.
  • Access necessary information from third-party platforms for identity verification and loan processing purposes.
  • Monitor your compliance with repayment obligations even if the App is uninstalled or inactive, until all outstanding dues are settled.

3. Services and Loan Processing

3.1 The Platform facilitates:

  • Loan applications submission and processing.
  • Verification of User Data and supporting documents.
  • Disbursement of Loans through Lenders after completion of verification procedures.

3.2 Users must complete all forms, including ECS/NACH authorization, cheques, and other documents requested by the Lender, to facilitate loan disbursement.

3.3 Loan repayment obligations continue regardless of whether the App is uninstalled, deleted, or Services are terminated.

3.4 FundExera does not make discretionary lending decisions; all approvals are at the Lender's sole discretion.

4. User Account and Privacy

  • 4.1 Users must create a User Account to access Services.
  • 4.2 Users are responsible for maintaining confidentiality of their login credentials and account activity.
  • 4.3 FundExera stores User Data securely and uses it to provide Services, perform verification, and communicate account-related information.
  • 4.4 By accepting these Terms, Users consent to FundExera accessing and using their data, including information obtained from third-party platforms, for Service delivery and loan verification purposes.

5. License to Use the App

5.1 FundExera grants Users a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes.

5.2 Updates or upgrades may be provided via authorized stores; failure to update may limit functionality.

5.3 Users may not:

  • Reproduce, distribute, sell, or exploit any part of the App.
  • Upload or transmit content that is unlawful, abusive, defamatory, obscene, or harmful.
  • Introduce malicious code or interfere with the Platform's operation.

6. Content and Intellectual Property

  • 6.1 All content, software, trademarks, logos, and branding on the Platform are owned by FundExera or licensed to it.
  • 6.2 Users may not use, reproduce, or distribute any intellectual property without prior written permission.
  • 6.3 Users are solely responsible for content they upload, share, or transmit on the Platform. FundExera disclaims all liability for damages arising from such content.

7. Third-Party Links and Advertising

  • 7.1 The Platform may contain links to third-party websites or services. FundExera is not responsible for their content, accuracy, or privacy practices.
  • 7.2 Third-party advertisements do not constitute endorsement by FundExera. Users are advised to contact advertisers directly regarding their services.

8. Ancillary Services

  • 8.1 Users may access additional features such as blogs, reviews, chat, and comments.
  • 8.2 Illegal activities, harassment, defamation, or violation of rights of others through these Services are strictly prohibited.

9. Termination

9.1 FundExera reserves the right to terminate Services or User access under the following circumstances:

  • Violation of these Terms.
  • Non-payment of outstanding amounts.
  • Legal or regulatory requirements.
  • Discontinuation of Services or App license expiry.

9.2 Upon termination, all licenses and rights granted to Users shall cease immediately, and Users remain liable for any outstanding debts.

10. Disclaimers and Warranties

  • 10.1 The Platform and Services are provided "as is" and "as available".
  • 10.2 FundExera disclaims all express or implied warranties, including merchantability, suitability for a particular purpose, and non-infringement.
  • 10.3 Users assume full responsibility for the use of the Platform, including any risks of data loss, system damage, or technical issues.

11. Indemnification

11.1 Users agree to indemnify and hold harmless FundExera, its affiliates, officers, employees, and partners from any claims, liabilities, or damages arising from:

  • Violation of these Terms.
  • Misuse of the Platform or Services.
  • Breach of law or rights of third parties.

12. Limitation of Liability

12.1 FundExera shall not be liable for any direct, indirect, incidental, consequential, or special damages resulting from:

  • Use or inability to use the Platform or Services.
  • Errors, delays, or interruptions in service.
  • Third-party actions, technical failures, or regulatory changes.

12.2 Users acknowledge that FundExera's liability is limited to the maximum extent permitted by applicable law.

13. Governing Law and Jurisdiction

13.1 These Terms shall be governed by and construed in accordance with the laws of India.

13.2 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

14. Amendments

14.1 FundExera reserves the right to modify, amend, or update these Terms at any time.

14.2 Users will be notified of material changes through the Platform, and continued use of Services constitutes acceptance of updated Terms.
